    摘要:

    实习大学生日渐成为一个庞大群体。然而,由于实习生市场供需矛盾突出,有关实习生的法律制度尚 不完善,实习生身份模糊,且学校、企业和实习生三者存在利益冲突,实习大学生的各项劳动权益常常受到侵害,其中 劳动报酬权利、休息休假权利和享受社会保险权利三者的受损情况最为突出。结合美国、英国和日本发达国家对实习生 的管理经验,建议发挥社会、学校、企业、学生本身四方在劳动权益维护中的作用,主要包括完善法律法规,明确实习 生身份地位;增进校企合作,避免实习生“单打独斗”;增强社会责任感,合理安排实习生;提高自我保护意识,积极 运用法律维权,逐渐建立与完善实习大学生劳动权益保障机制。

    Abstract:

    Recently college interns become a large group. But the intern market contradiction between supply and demand is prominent, the legal system about the intern isn’t perfect, and the benefits which universities’ manager, enterprises and the students pursue are different, causing interns’ rights and interests are invaded constantly. Learning the experience of United States, Britain and Japan, the paper puts forward some advice on the interns’ protection, mainly including the government on its part perfects the law; universities and colleges promotes the cooperation between enterprises, and take the insurance of interns’ labor rights and interests into their responsibility; interns themselves should learn to defend their rights and interests, thus establishing and improving the protection of labor rights and interests of college students gradually
