Abstract:This paper analyzes the impact of fertility particularly the two-child policy on women's employment rights mainly with the human capital theory, career theory and statistical discrimination theory through 50 cases of interviews, 4 groups discussion in 2017, 2016 and 2014 and questionnaire of 7573 married women in 2010. The impacts include the negative impact of fertility on women's employment opportunities and career development, the protection of maternity insurance and the positive response of enterprise on two-child policy. It discusses the strategy and measures based on the “two kinds of production” theory and combined with experience and positive measures of domestic and foreign women's employ-ment rights protection.
