Abstract:The mediation system of the Alternative Dispute Resolution is becoming more and more important as the core system to adjust the labor relations and solve the contradiction between labor and capital. However, the current mediation mechanism of interest disputes in China is not yet mature and needs to be transformed. At present, the research in this field is mostly aimed at foreign national conditions, which can not provide ideas for China's transformation. Therefore, this paper draws on the comparative method from the comparative study of foreign mediation system, and then selects some developed countries with similar experiences in China and the developed countries with perfect mediation system, then to study their mediation characteristics. Finally, based on China's national conditions, sum up the experience of other countries for the reform of China's mediation system, such as raising the level of legislation, improving the membership setting and appointment of policy recommendations.
