    摘要:

    受民主化改革的影响,缅甸政府近些年积极推动劳动立法建设,并积极承诺遵守国际劳工标准。 在此背景下,中资企业在缅甸面临的劳工风险不断加大,立法标准的提高造成了用工成本的上涨,工会运动的兴 起加重了企业面临的劳资纠纷压力,西方国家政治力量的干预使得劳工问题亦具有政治化的风险,影响了我国“一 带一路”倡议在缅甸的推进。为此,我国政府和企业应当密切关注缅甸劳动立法改革动向,建立健全生产行为守则, 并加强企业的集体谈判能力建设,以降低企业经营的劳动法律风险,促进投资的经济利益与社会利益相平衡, 保障“一带一路”建设目标的实现。

    Abstract:

    Under the influence of democratic reform, constructing the labor legislation system has been improved in Myanmar in recent years with its positive commitment of the government by adhering to the international labor standards. Thus, the labor risk of Chinese enterprises in Myanmar has risen, which is hampering the progress of the Belt and Road Initiative. As a result, the Chinese government and enterprises should pay more attention to Myanmar’s labor legislation reform to reduce the labor risk of Chinese enterprises and to balance the economic benefits and social interests of investment by establishing related code of conduct and strengthening Chinese enterprises’ collective bargaining ability. The achievement of the Belt and Road target, hence, can be guaranteed.
