Abstract:Recent years witness the rapid development of the sharing economy based on the Internet platform, and the newly established sector generates a great deal of social wealth. A new form of flexible employment based on the Internet platform has also emerged. Since the traditional labor law framework based on the binary demarcation of labor relations and employment relations cannot adapt to this new form of employment, the rights of labors cannot be guaranteed. Thus, the new service triggers a series of new labor disputes. This paper, drawing lessons from the middle subject system of the foreign law, proposes adjusting the framework of the traditional labor law, and establishing economically dependent workers. To maintain the normal order of the labor market, thus, a balance should be made between the employment cost of the enterprise and the rights protection for laborers
