Abstract:Part-time jobs, compared with traditional full-time jobs, have the characteristies of stronger flexibility, fewer restrictions, and higherefficiency. The gig economy, hence, has positive significance for workers, enterprises, and the government as well. However, what urgently needsto be resolved at present is the definition of the identity of gig workers, which is related to the protection of their legitimate rights and interests.Califermia's recently issued gig economy law which has actually changed the Borello inspection standard used to distinguish whether gig workers areemployees or independent contractors to the ABC inspection slandard. The implementation of the new standard is conducive to the identifcation ofgig workers as employees, and thereby,it effectively protects the rights and interests of workers,and also has a strong reference value for future legalprotection of gig workers in our country.
