    摘要:

    中国工会“维权”和“维稳”的双重角色性一直是学界和实务界讨论的重点问题。本研究首先 探究了中国工会双重角色的理论发展脉络,然后通过多案例研究方法,对劳资双方的利益进行类型化梳理,构 建中国工会组织双重角色协调机制模型,最后据此提出工会双重角色“并存”和“冲突”两种运行方式下的协 调策略。研究认为:从工会理论的发展来看,中国工会双重角色属性具有正当性;以不同利益形态类型作为介 入前提,工会的双重角色具有并存和冲突两种运行方式;角色并存以总工会搭建平台、多部门联合、基层工会 组织集体协商为协调策略,角色冲突的协调机制应遵循“维稳优先”原则,并通过多主体协同解决补充冲突中 的双重角色运行顺序差异。

    Abstract:

    The dual role of trade union in safeguarding rights and maintaining stability in China have been the focus of discussion in academic fi eld and judicial practice as well. This study fi rstly explores the theoretical development context of the dual role of trade union in China, and then, by using the multi-case study method, sorts out the interests of labor and management, and sets up a model of the coordination mechanism of the dual role of trade union organizations in China. Finally, it proposes a coordination strategy under the two modes of operation of the dual role of trade union — "coexistence" and "confl ict". The research shows that, from the perspective of the development of trade union theory, the dual role attributes of trade union in China have legitimacy; with different types of interests as the prerequisite for intervention, the dual role of trade union has two modes of operation: coexistence and confl ict; the role coexists with the coordination strategy of the central trade union building platform, multi-sector alliance, and collective consultation of grassroots trade union organizations. The coordination mechanism of role confl icts should follow the principle of "maintaining stability fi rst", whilst the dual role operation order differences in supplementary confl icts should be solved through multi-subject coordination.
