Abstract:The continuous development of digital and information communication technologies has led to the disappearance of the boundary between workers' work and life, resulting in an imbalance and even conflict between the two. However, in the context of inadequate protection of the right to rest in China, the protection and implementation of right to disconnect are even more difficult. We should distinguish and analyze the relationship and differences between right to disconnect and rest rights, explore the necessity of offline rights protection, and analyze and solve the institutional, conceptual, and theoretical roots of right to disconnect protection in China. Specifically based on the institutional foundation, a comprehensive labor rights protection plan arrangement and reporting feedback system can be formulated, and the protection of working hours can be enforced; In terms of ideological transformation, we should correct the game theory of mismatched labor and capital, and build a healthy relationship of mutual benefit between labor and capital; In terms of protection mode, the theory of work life balance should guide the long-term development of China's protection system of right to disconnect. In the short term, the employment behavior of enterprises can be regulated by increasing labor costs, in order to accelerate the implementation of right to disconnect protection in China and achieve the long-term development and overall benefits of Chinese workers, enterprises, and society.
