Abstract:As a unique form of new employment, the online streamer industry has injected new vitality into the job market through its diverse and flexible employment models. However, due to the weak subordinate relationship between online streamers and online platforms, it is challenging to unify the legal relationships within the framework of labor relations. Thus, it is necessary to explore how to provide sufficient legal rights protection for online streamers This study proposes that the following measures be taken: to implement classified protection based on the diverse characteristics of employment models of online streamers, integrate them into labor relations or adjust for incomplete labor relations, and offer corresponding legal guarantees. Moreover, for online streamers who do not have complete labor relations, they can refer to the standards of labor compensation, working hours, rest time, and social insurance, etc., as established by employers with formal labor relations. They should design different levels of labor insurance coverage, labor compensation, and labor protection conditions based on their specific circumstances.
